Below is a sample of the contract that Berry Patch Dolls requires for all
individually sculpted portrait dolls. Details may be adjusted to fit
circumstances.
Contract for Art Work
Client (name)
(Client) hereby commissions doll artist, Carolyn Jones (Artist) to create a
portrait doll of (Subject).
(Client) will provide photographs of (Subject) that are of appropriate quality
for Artist to use in sculpting likeness. Photographs will be returned to
(Client) upon completion of project.
In consideration of One thousand one hundred Dollars ($1200.00) with a
twenty-five percent or three hundred Dollars ($300) down payment due at signing
of this contract and the remainder, nine hundred dollars ($900) due upon
completion of doll, the Artist will create a likeness in clay, molds and one
finished porcelain doll. The doll will be approximately 25 inches tall with a
moveable porcelain head, shoulder plate, lower arms and three-quarter legs
(standing doll) or one-half legs (sitting doll). The torso will be cloth with
full wire armature. Client may select sitting or standing position for doll.
Eyes will be blown glass, wig will be of synthetic fiber. Costume style will be
selected by the Client and will consist of a dress, slip, panties, socks and
shoes. Material will be cotton or cotton blend fabric and lace trim, if used,
will be cotton blend. There will be an extra charge for any variations in these
specifications. Doll will be signed and dated by the Artist.
Additional dolls, made from the same mold, with the same specifications as
listed above, may be purchased from the artist at a cost of eighty hundred
dollars ($800.00) per doll.
Doll will be completed and delivered to Client no later than (agreed upon date
of completion). Client will be kept informed of progress. Artist will provide an
opportunity for Client to view pictures of and approve completed clay sculpture
before molds are made. Any changes client wants made to sculpture must be
requested at this time. It is understood that this will be the Artist's
interpretation of the Subject and not a photographic likeness.
Artist will retain molds and may use same to produce her own limited edition
dolls, but none of these dolls shall be finished to resemble Subject.
This agreement shall be binding upon the Client, his/her successors and personal
representatives.
Should Artist be unable to complete project, all moneys shall be refunded to
Client.
